Cindy places an advertisement in a newspaper, which states:

“HardFloor-the best floor hardener in the world can withstand any impact or vibration without cracking”.

The advertisement also claims “If you use HardFloor on your floor, the company guarantees that it will pay $100,000 if the floor cracks.” The advertisement goes on to say that Cindy has deposited “$1 million in a local bank in the unlikely event of any claims ”.

Jeremy, a circus performer, has a group of ten elephants which do tricks for the audience. Jeremy is building a training room for his elephants and notices Cindy’s advertisement. He decides to use HardFloor in his training building. After six months, due to the weight of the elephants, the floor develops cracks. Jeremy asks Cindy for $100,000 but she refuses to pay.
